Terms and Conditions

 

Introduction

 

The following booking conditions form part of your contract with Breedekloof Camino, a partnership that operates as an outdoor adventure and tour facilitator in South Africa ("we", "us", and "our"). Please read them carefully as they outline our respective rights and obligations. By requesting us to confirm your booking, you confirm that you have read and agree to these booking conditions. These conditions apply solely to the tour arrangements you book with us and that we agree to provide as part of our contract with you. All references to "tour", "booking", "contract", or "arrangements" refer to such tour arrangements unless stated otherwise. References to "departure" mean the start date of these arrangements.

 

COVID-19 Notice

 

You acknowledge that traveling during the COVID-19 pandemic is your personal decision, undertaken with full awareness of current travel recommendations and restrictions. We are not liable for any unsafe conditions or health hazards, including pandemics or other illnesses you may encounter. We will use reasonable efforts to provide you with the latest travel information available to us regarding COVID-19 regulations and conditions at the time of your booking. Neither we, our employees, nor our agents will be responsible for any loss, damage, illness, harm, trauma, death, delay, denial of onward travel, or costs (including quarantine costs) you may incur, whether during or after the tour, related to the risks of traveling during the pandemic. Most insurance policies exclude coverage for pandemics, especially when travel warnings are issued. We recommend consulting an insurance broker about the appropriateness of a travel insurance policy. We are not liable for your choice not to purchase insurance nor for any claim made by a travel insurer related to COVID-19.

 

Booking Your Tour

 

Provisional bookings will only be made upon our written confirmation of your requested tour. If you are under 18 years old at the time of booking, a parent or guardian must also sign the application form during the booking process.

 

Prices and Payment

 

All tour prices include VAT.

If the balance of the total booking value (including any applicable surcharge) is not received by the due date, we reserve the right to treat your booking as canceled by you, and you will be liable for the cancellation charges outlined below.

 

Changes and Cancellations

 

Changes

Changes to your confirmed tour may be considered depending on practicalities and availability, and associated costs may apply.

 

Cancellations

Cancellations must be notified to us by email as soon as possible. Your notice of cancellation will be effective only when receipt is confirmed by us in writing. The following cancellation charges and refund terms will apply:

 

- Cancellations made 31 or more days prior to departure:0% cancellation fee, 100% refund

- Cancellations made 30 days or less prior to departure: 100% cancellation fee, 0% refund

 

Third-Party Service Providers

 

Your tour may include services provided by third parties. We do not accept liability for any loss, damage, injury, illness, harm, or death resulting from any act or omission by a third party where they fail to meet their obligations to you, whether related to accommodation arrangements or otherwise.

 

Travel/Medical Insurance

 

We recommend that you have adequate and appropriate insurance coverage for your tour, ensuring that all activities you will engage in are covered. Please read your policy details carefully and bring them with you on your tour. It is your responsibility to ensure that your insurance cover is suitable and adequate for your needs.

 

#### Indemnity

 

**Our Liability to You**

We promise to ensure that the tour arrangements we have agreed to make, perform, or provide as part of our contract with you are carried out with reasonable skill and care. We are responsible only for our employees, agents, and suppliers failing to exercise reasonable skill and care if such failure occurred while acting within their scope of employment with us or performing work we had asked them to do.

 

We ensure that all operators included in the tour are fully licensed, registered with the relevant authority, have the necessary liability insurance in place, and follow procedures in line with current COVID-19 protocols as set by the Government of the Republic of South Africa.

 

You acknowledge that the tour or part thereof may be dangerous, and you participate voluntarily and at your own risk. We are not responsible for any injury, illness, death, loss (including possessions and enjoyment), damage, expense, cost, or other claims resulting from:

 

- Your acts or omissions;

- Acts or omissions of a third party not connected with the provision of your tour, which were unforeseeable or unavoidable;

- "Force majeure" as defined in paragraph 11 below.

 

Your Liability to Us

You are responsible for declaring any existing medical conditions or disabilities that may affect your ability to undertake the tour before booking. You are also responsible for your behavior and that of your party. We and our suppliers reserve the right to refuse your booking or remove you and/or any member of your party from any transport, accommodation, or part of your tour if you or any member of your party is drunk, under the influence of alcohol or drugs, in unlawful possession of drugs, or behaving violently, disruptively, dangerously, or irresponsibly, or in any manner presenting a risk or nuisance to others. No refund or compensation will be given, and no costs incurred by you will be recoverable from us in such circumstances.

 

Jurisdiction

 

We agree that South African law will apply to your contract and any dispute, claim, or other matters arising between us. Any claims must be dealt with by the courts of the Republic of South Africa only.

 

Privacy Policy

 

Protecting your personal information is crucial to us. To respond to an inquiry, process and fulfill your booking, or send you promotional materials, we need to collect personal data from you. We will only process your personal data for the purpose you provided it or as permitted by data protection laws. You and your data are protected by the Protection of Personal Information Act 4 of 2013 (POPIA). We take appropriate measures to protect against unauthorized processing and accidental loss or destruction of personal data. You may request information on what personal data of yours we hold, for what purpose, and to whom it has been disclosed. You may also withdraw consent to receiving marketing materials or other communications from us at any time. Force Majeure

 

In these booking conditions, "force majeure" means any event that we or the service supplier could not foresee or avoid with all due care. Such events include, but are not limited to, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, significant health risks, adverse weather conditions, fire, and similar events outside our control. We cannot accept liability or pay compensation for any damage, loss, or expense resulting from "force majeure".

 

Notices and Address

 

We designate ,,,,, as the address for service of any notice, consent, approval, or other communication. We acknowledge the address you provide on the contract signature page.

 

General

 

This document, including all annexures, constitutes the entire agreement between you and us. No representations, warranties, undertakings, or promises not contained herein will be binding. No alterations, variations, or cancellations of this contract will be effective unless in writing and signed by both parties. Failure to enforce any provision does not waive the right to enforce it in the future. If any provision is rendered void or unenforceable, the remaining provisions will remain binding. This contract may be signed in counterparts, each of which will be considered an original.
